In a ruling handed down on <em>March 12, 2025<\/em>, the <em>Supreme Court of Benin<\/em> overturned the decision of the Autorit\u00e9 de R\u00e9gulation des March\u00e9s Publics<em>(ARMP<\/em>), which had banned him for five years for alleged irregularities in the management of public contracts within the Commission B\u00e9ninoise des Droits de l&#8217;Homme (CBDH).<\/p>\n\n\n\n\n\n<p>The case dates back to April 18, 2024, when ARMP ruled that he should be excluded from public procurement for the period from <em>May 6, 2024 to May 5, 2029<\/em>. <\/p>\n\n\n\n\n\n<p>This sanction was the result of a self-referral by the regulatory body, motivated by a letter from the CBDH executive board, with the exception of its president, denouncing several alleged irregularities:<\/p>\n\n\n\n\n\n<ul class=\"wp-block-list\">\n\n<li><em>Conflicts of interest<\/em><\/li>\n\n\n\n\n\n<li><em>Fraud in the award and payment of public contracts<\/em><\/li>\n\n\n\n\n\n<li><em>Counter-performance in internal management<\/em><\/li>\n\n<\/ul>\n\n\n\n\n\n<p>A central point of the accusation was the absence of internal control structures, notably the Cellule de contr\u00f4le des march\u00e9s publics. Following an investigation, ARMP concluded that Cl\u00e9ment Capo-Chichi was responsible in his capacity as approving authority, and sanctioned him along with two other people.<\/p>\n\n\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-un-recours-en-justice-abouti\">Successful legal action<\/h3>\n\n\n\n\n\n<p>Cl\u00e9ment Capo-Chichi considered this decision unjust, and lodged an appeal with the Supreme Court on <em>May 22, 2024<\/em>. After analyzing the case, the Administrative Chamber of the Supreme Court ruled that his appeal was admissible and well-founded, thus annulling the ARMP&#8217;s sanction against him.<\/p>\n\n\n\n\n\n<p>This verdict officially cancels Cl\u00e9ment Capo-Chichi&#8217;s exclusion and calls into question the procedure which led to his sanction.
